“On September 10, 2001, I landed in New York City for a mediation with an insurance company in which we needed to secure coverage for about $12M in construction products litigations filed against our client in California, Wisconsin, and New York.  The case also involved our client’s insurance broker, whose offices had been located in the World Trade Center, where we had frequently met.  I still have my WTC photo ID dated 4-11-01.  The mediation ended up taking place the next week across the Hudson in Newark, New Jersey, where we achieved full coverage for the past claims and a coverage-in-place agreement for future claims.  One such claim later ballooned into a mammoth putative class action, which we defeated with defense dollars paid for by the coverage-in-place agreement.”
