
“At the time, it was the largest bankruptcy ever in California. We represented the creditors’ committee in the pursuit of environmental coverage against 16 insurance carriers. The case involved underground storage tanks and bunkers in multiple locations in central California, which we personally inspected. Through numerous adversary proceedings, we recovered the entirety of the costs of remediation. In one such proceeding, we argued and won reversal in the U.S. Court of Appeals for the Ninth Circuit in KF Dairies, Inc. v. Fireman’s Fund Ins. Co., 224 F.3d 922 (9th Cir. 2000), in which the Ninth Circuit adopted the after-acquired property doctrine notwithstanding California appellate authority rejecting that doctrine.”
